Terry gagging order lifted by High Court

An order preventing the media from reporting details of England football captain John Terry's private life has been lifted by the High Court.

Mr Justice Tugendhat removed the injunction, taken out by Terry, which banned reports about the Chelsea star's alleged affair with an unnamed woman.

An interim order had been granted at a private hearing in London last Friday.

It had banned publication of details of the alleged relationship and barred the use of photographs relating to it.

However, the judge said the information was in "wide circulation amongst those involved in the sport in question, including agents and others, and not just amongst those directly engaged in the sport".

Justice Tugendhat said he thought Terry's real concern was the effect on his sponsorship contracts, in which case, payment of damages would be an adequate remedy if he succeeded at trial.

The judge said: "Freedom to live as one chooses is one of the most valuable freedoms, but so is the freedom to criticise".

Lawyers for Terry had obtained the injunction a week ago, after learning that the News of the World planned to write about him.

BBC media correspondent Torin Douglas said the existence of these so-called super-injunctions had become more widely known recently.

He said: "Lawyers for the oil trading firm Trafigura stopped a parliamentary question being reported by the Guardian, until its identity became widely known via the Twitter social network.

"This ruling recognises the right of media to report."

News of the World legal manager Tom Crone welcomed the decision as "a long overdue breath of fresh air and common sense".

"Over recent years, there has been more prior restraint on freedom of speech in Britain than in any other democratic country in the world," he said.

"Gagging orders like the one sought by John Terry have been granted to numerous other Premier League footballers and assorted celebrities."

He said he hoped the ruling would lead to "a fundamental reassessment of our draconian privacy laws".

A Chelsea spokesman said: "This is a personal matter for John Terry. The club will give John and his family all the support they need in dealing with it."

Terry, 29, married childhood sweetheart Toni Poole in 2007 and is the father of twins. He is expected to captain England at this summer's World Cup finals in South Africa.

I agree with you but you know what media can be like also didn't Fabio warn players about behavior off the pitch and places would be at risk? Be interesting to see if anything is done.

John Terry could lose the England captaincy after details of his affair became public last night.

Fabio Capello will monitor the fall-out from Terry’s extra marital relationship with England team mate Wayne Bridge’s former partner Vanessa Perroncel
England boss Capello has a strict code of conduct for players and is known as a disciplinarian.

He faces a huge dilemma as he prepares the squad for the World Cup finals because he believes players’ private lives should not effect footballing issues.

However, he fears a backlash in the dressing room and is anxious to ensure that Terry has the respect of his team mates ahead of this summer’s tournament in South Africa.

Father-of-two Terry, who is married to Toni Poole, was close friends with ex-Chelsea team mate Bridge who only split up with French model Perroncel in December.

It is believed that some of Terry’s Chelsea’s team mates have told him they did not approve while Manchester City’s players are strongly behind their team mate.

The FA insist Terry's future as captain is a matter for Capello who is currently recovering after a knee replacement operation.

He has been kept up to date with developments this week with the affair kept under wraps until yesterday’s “superinjunction“ was lifted.

But as news came out about the affair, a questionnaire run by internet firm One Poll, found that 87 per cent of 2,000 people quizzed believed Terry should be stripped of the captaincy.

Sources close to Capello said the England manager would see what the fall-out was over the weekend before making a decision but it could be that Terry loses the captaincy for the friendly against Egypt on March 2.

Last night, Chelsea were standing by their captain as he travelled with the rest of his team mates and is expected to start in today’s game at Burnley.

Bridge, long-term England left-back under-study to Ashley Cole, has not played since early December when he was injured playing against Chelsea.

A Chelsea spokesman said: "This is a personal matter for John Terry. The club will give John and his family all the support they need in dealing with it."

Well, atleast, England have an excuse when we don't win the World Cup :bleh: :D

You can't drop John Terry, regardless. In fact, if you have a choice to whether to take Terry or Bridge then it is Terry. Bridge has played in a very leaky defence, atleast, most of the season before Roberto came, and Wayne was responsible for quite a few of the goals.

Terry is a bigger asset.

I actually can't believe John Terry has done this , I always thought he was a nice guy :o lol !!! If he does get the England armband taken away from him which I think is abit silly but can understand why then I hope Rooney get's it next :D !!
